“Conversion” is the right to convert an employee's group coverage to individual coverage if membership in the group ends. Idaho law requires that insurers offer individual or alternate group coverage to anyone whose federal Consolidated Omnibus Budget Reconciliation Act (COBRA) benefits terminate, who declines COBRA coverage, or whose group coverage otherwise terminates. The coverage may not be conditioned on the individual's medical history or health status, and preexisting conditions must generally be covered.
Idaho law requires that insurers offering or maintaining group major medical insurance policies in Idaho must make a current group or individual policy available to an individual or dependent of an individual covered under such a policy following expiration or the insured's declination of COBRA benefit coverage, if applicable, or otherwise upon termination of group coverage. Coverage may not be conditioned on the individual's age, health or medical history, or employment status. The insurer must offer benefits equal to what the insured had under the existing policy with the company (ID Stat. Sec. 41-2220). A "major medical policy" is defined as insurance that provides hospital and medical/surgical coverage.
