New York Holidays: What you need to know

New York state observes the following as official holidays:
January 1New Year's Day
Third Monday in JanuaryMartin Luther King Jr. Day
February 12Lincoln's Birthday
Third Monday in February Washington's Birthday
Last Monday in MayMemorial Day
Second Sunday in June Flag Day
July 4Independence Day
First Monday in September Labor Day
Second Monday in October Columbus Day
First Tuesday after First Monday in NovemberElection Day
November 11Veterans Day
Fourth Thursday in NovemberThanksgiving Day
December 25Christmas Day
When any holiday, except for Flag Day, falls on a Sunday, it is observed on the following Monday (NY Const. Laws Sec. 24).
State employees. Except for Flag Day, all state offices are closed on the holidays listed, and state employees are entitled to the holidays as paid days off (NY Civ. S. Appx. Sec. 28-1.1).
Private employers. Private employers are not required by state law to provide any holidays as paid (or unpaid) days off. No New York state law requires that employers:
• Pay premium pay to employees who work on holidays
• Pay employees for unworked hours on holidays
• Count unworked hours on holidays as “hours worked” when computing overtime
However, many state employers follow one or more of these practices.
