New Jersey Jury Duty/ Court Appearance: What you need to know

Time-off requirements. In New Jersey, employees must be allowed time off to serve jury duty. Residents may not be summoned to jury duty within 3 years of their last jury service in that county. To be deferred, documentation of previous service must be presented (NJ Rev. Stat. Sec. 2B:20-17).

Verification of jury service. Employers may obtain verification of an employee's service by sending a written request to the jury management office of the appropriate court.
Under state law, an employer may not penalize an employee with respect to employment, or threaten or otherwise coerce an employee because the employee is required to attend court for jury service (NJ Rev. Stat. Sec. 2B:20-17). An employer that violates the law is guilty of a disorderly persons offense and may be liable for economic damages suffered by the employee as a result of the violation, attorneys’ fees, and reinstatement.
Public employers. Public employers are required to excuse any full-time employee for jury service in any state court, any federal district court or the United States District Court for New Jersey, or any court of another state. The public employer must pay the employee's usual compensation for each day the person is present for jury service, in lieu of the amount of per diem juror's fees (NJ Rev. Stat. Sec. 2B:20-16).
Private employers. Private employers are not required to provide paid leave for employees on jury duty. Although not required to do so, most employers do pay all employees called to jury duty or a court appearance, regardless of exempt or nonexempt status.
