Oklahoma Jury Duty/ Court Appearance: What you need to know

Under Oklahoma law, jurors must be reinstated to their same position at the completion of jury duty. It is illegal to discharge or discipline an employee for taking time off to serve as a juror provided that the employee notifies his or her employer within a reasonable period of time after receipt of the jury summons.

It is also illegal to require or request an employee to use sick, annual, or vacation time when serving as a juror. However, an employee may decide on his or her own volition to use paid time leave for this absence. Violation of this law is punishable by fine. In addition, discharged employees may sue the employer for actual and punitive damages (OK Stat. Tit. 38 Sec. 34 and Sec. 35).
Courts are required to automatically postpone and reschedule the service of a summoned juror who works for an employer with five or fewer full-time employees, or their equivalent, if another employee has previously been summoned to appear during the same period.
Oklahoma currently has no law regarding employees of private employers who miss work for a court appearance unrelated to their employment.
Oklahoma law does not require private employers to pay employees for time off for jury or witness duty. Although not required to do so, many employers do pay all employees called to jury duty or court appearances, regardless of exempt or nonexempt status. Some courts pay jurors a small fee, and the employer may offset any amounts received by an employee for a particular week against the salary due for that particular week.
