Mississippi Sick Leave: What you need to know

There is no Mississippi law requiring private employers to grant their employees paid or unpaid sick leave although many employers do grant it as a popular employee benefit. It is important to remember that if sick leave is promised, an employer may have a legal obligation to grant it. Courts have held that under certain circumstances, policies published in employee handbooks or relied-on oral promises may constitute binding and enforceable implied contracts.

Mississippi law mandates major medical leave for state employees according to the following schedule:
• Eight hours per month or 12 days per year through 3 years of work
• Seven hours per month or 10.5 days per year from 37 months through 8 years of work
• Six hours per month or 9 days per year from 97 months through 15 years of work
• Five hours per month or 7.5 per year for subsequent years
Eligible employees. All state employees (except part-time temporary employees of the public universities and persons on full-time educational leave) accrue credits for major medical leave. Part-time employees accrue major medical leave on a pro rata basis. There is no maximum limit to major medical leave accumulation.
Use of leave. Major medical leave may be used for the illness or injury of an employee or member of the employee's immediate family only after the employee has used 1 day of accrued personal or compensatory leave for each absence due to illness, or leave without pay if the employee has no accrued personal or compensatory leave. However, major medical leave may be used without prior use of personal leave to cover regularly scheduled visits to a doctor's office or a hospital for the continuing treatment of a chronic disease, as certified ...
