Pennsylvania Sick Leave: What you need to know

There is no Pennsylvania state law requiring private employers to provide employees sick leave, paid or unpaid, although many employers do grant it as an important employee benefit. It is important to remember, however, that if sick leave is promised, an employer may have a legal obligation to grant it. Some courts have held that under certain circumstances, policies published in employee handbooks may constitute implied contracts that are binding and enforceable. Thus, employers should regularly review policy statements made in handbooks or elsewhere to ensure that they accurately reflect current policies. If not, they should be changed, and employees should be notified of the changes.

Pennsylvania provides 13 days of sick leave per year to state employees. Employees receive one personal day the first calendar year of employment, 2 personal days the second calendar year, and four personal days each year thereafter. Some corrections officers have paid time off rather than sick, annual, or personal leave.
Accrual of sick leave. Sick leave begins to accrue immediately and can be used immediately.
Use of sick leave. State employees can use their sick leave for their own illness or to care for family members. An employee can receive direct donations of additional paid leave from co-workers.
Effective July 1, 2012, the city of Philadelphia requires certain employers that do business with the city to provide full-time employees with paid sick leave.
