South Carolina Deductions From Pay: What you need to know

Under South Carolina law, employers are not permitted to make deductions from an employee's pay unless the employer is required to do so by law, e.g., for federal or state tax withholding; or the employer has given written notification to the employee of the amount and terms of the deductions as required by state law (SC Code Sec. 41-10-40). Employers are required to notify employees in writing at the time of hiring of the deductions that will be made from their wages, including deductions for payments to insurance programs (SC Code Sec. 41-10-30).

Employers may make deductions from an employee's wages as payment of dues to a labor organization, provided the employee authorizes the deduction in writing and the written authorization may be revoked after 1 year or upon the termination date of the applicable collective bargaining agreement, whichever comes first (SC Code Sec. 41-7-40).
Employers in South Carolina may deduct from an employee's wages the cost of uniforms that the employer requires the employee to wear, as long as this is stated in the company policy manual. Employers may also deduct the cost of the laundering or dry cleaning if done by the employer.
An assignment of wages is a method of debt repayment in which part of an employee's pay is withheld and paid over to the creditor. In South Carolina there are two types of wage assignments: an assignment to secure the purchase of goods on credit and an assignment for child or spousal support.
