Hawaii Minimum Wage: What you need to know

Several occupations and industries are exempt from Hawaii's minimum wage provisions, including (HI Rev. Stat. Sec. 387-1et seq.):
• Automobile or truck salespersons for licensed dealers
• Employment by certain relatives
• Domestic servants
• Taxi drivers
• Outside collectors and salespersons, including car salespersons
• Those engaged in the farming, harvesting, or catching of aquatic animal or vegetable life
• Golf caddies
• Students working for their nonprofit schools
• Seasonal employees of certain youth camps
• Houseparents in charitable child-welfare shelters
• Merchant marines working on a ship or vessel
• Employees engaged in coffee harvesting and any other agricultural work in which the employer has fewer than 20 employees a week
• Bona fide administrative, executive, supervisory, and professional employees
• Employees earning guaranteed compensation of at least $2,000 per month
The state director of Labor and Industrial Relations may issue special certificates allowing employment at wages below the minimum for learners, apprentices, youth parolees, certain full-time students, and those impaired by old age or disability (HI Rev. Stat. Sec. 387-9).
Employers may apply the actual cost of meals, lodging, and other facilities furnished by the employer toward the satisfaction of minimum wage requirements (HI Admin. Rules Sec. 12-20-9). Employers are not permitted to apply the cost of facilities that primarily benefit the employer (e.g., tools or uniforms required by the nature of the business).
Hawaii employers must post the provisions of the state minimum wage law in a conspicuous location in the workplace. A poster that satisfies this requirement is available free of charge from the Hawaii Department of Labor and Industrial Relations Wage Standards Division.
