New Mexico Minimum Wage: What you need to know

You can find your state’s minimum wage rate and tip credit laws at http://hr.blr.com/state-comparison-charts/Updated-Minimum-Wage-Chart. Employees who are covered by both state law and the federal Fair Labor Standards Act (FLSA) must be paid the higher of the two minimum wage rates (NM Stat. Sec. 50-4-22).

Several occupations and industries are exempt from New Mexico's minimum wage provisions, including:
• Domestic or household workers
• Sales personnel compensated on a commission basis
• Most farmworkers, including livestock or milk production
• Employees handling or processing any agricultural or horticultural commodity in its unmanufactured state
• Government employees (Note: State and local government employees must be paid the state minimum wage but are exempt from the law's other provisions.)
• Employees paid on piecework, flat-rate, or commission basis
• Noncollege students working after school and during vacation
• Employees under the age of 18 who are not students or high school graduates
• Ambulance service workers
• Registered apprentices
• G.I. Bill trainees
• Seasonal employees under certificates from the commissioner
• Superintendents and supervisors
• Volunteers at nonprofit organizations
• Executive, administrative, and professional employees
For any contract or project in excess of $60,000 that is solicited by the state or a political subdivision, all workers must be paid the prevailing wage as is determined by the director of the Wage and Hour Bureau of the Department of Workforce Solutions. Employees engaged in public works projects must be paid weekly (NM Stat. Sec. 13-4-11).
