Utah Minimum Wage: What you need to know

The following workers are exempt from Utah's minimum wage provisions (UT Code Sec. 34-40-104):
• Outside salespersons
• Members of the employer's immediate family
• Certain companions, casual and domestic employees
• Seasonal employees of nonprofit camping programs, religious or recreation programs, and state-registered nonprofit education and charitable organizations
• Federal employees
• Prisoners employed through the penal system
• Certain agricultural employees
• Certain apprentices or students employed by their schools
• Hourly workers of seasonal amusement parks if tips, commissions, or other pay bring average hourly pay up to minimum wage
• Certain individuals with disabilities
The Labor Commission may issue special certificates allowing employment at wages below the minimum for learners and employees with disabilities. Minors may be paid a subminimum wage per hour for the first 90 days of employment (UT Code Sec. 34-23-301).
Every employer with at least one employee who is covered by the Fair Labor Standards Act (FLSA) must post a notice outlining the federal minimum wage requirements. This notice is available online at http://www.dol.gov/whd or from:
