Washington Minimum Wage: What you need to know

Several occupations are exempt from the minimum wage provisions of the Washington law, including (WA Rev. Code Sec. 49.46.020):
• Certain hand-harvest agricultural workers paid at “piecework” rates
• Casual laborers working in or about a private home
• Bona fide salaried executive, administrative, or professional employees who are paid at specified minimum levels
• Volunteers serving government agencies or nonprofit organizations
• Newspaper carriers and vendors
• Employees of common carriers subject to the Interstate Commerce Act
• Forest protection and forest fire prevention workers
• Employees of charitable institutions engaged in character-building or recreational activities for young people or members of the armed forces
• Employees required to reside or sleep at the place of employment or required to spend substantial time on call
• Inmates, residents, or patients of a state, county, or municipal correctional, detention, treatment, or rehabilitative facility
• Public office holders
• Crews of Washington state ferries
• Seamen on foreign vessels
Employers must pay pieceworkers for rest breaks separate and apart from the piece rate. The rest breaks for pieceworkers must be paid at least at the applicable minimum wage or the employee's regular rate, whichever is greater. To calculate a pieceworker's regular rate, employers should tally the total piece-rate earnings and divide those earnings by the hours the pieceworker worked, excluding rest time.
Minors. Children under the age of 16 may be paid 85 percent of the minimum wage.
