Nevada Overtime: What you need to know

Under Nevada's overtime law, an employer must pay each employee overtime in the amount of 11/2 times the employee's regular pay rate for hours worked in excess of 8 in a workday or 40 in a workweek. Employers and employees may agree to a 10-hours-per-day, 4-days-per-week schedule with no overtime (NV Rev. Stat. Tit. 53 Sec. 608.018et seq.). Federal law requires overtime pay only after 40 hours in a workweek, so employers covered by both federal and state law must follow the state law to the extent it is more favorable to employees.

Several occupations and industries are exempt from Nevada's overtime provisions, including:
• Employees who are not covered by the state's minimum wage provisions
• Employees who receive compensation for employment at a rate not less than 11/2 times the minimum rate
• Outside buyers
• Employees in a retail or service business if their regular rate of pay is more than 11/2 times the minimum wage, and more than 1/2 of their compensation for a representative period comes from commissions on goods or services, with the representative period being at least 1 month
• Employees who are employed in bona fide executive, administrative, or professional capacities
• Employees covered by collective bargaining agreements that provide for overtime
• Drivers, drivers' helpers, loaders and mechanics for motor carriers subject to the Motor Carrier Act of 1935
• Employees of a railroad
• Employees of a carrier by air
• Drivers or drivers' helpers making local deliveries and paid on a trip-rate basis or other delivery payment plan
• Drivers of taxicabs or limousines
• Agricultural employees
• Employees of business enterprises having a gross sales volume of less than ...
