West Virginia Paychecks: What you need to know

“Wages” refers to all forms of compensation, whether fixed or determined by time, job, piecework, commission, or any other method (WV Code Sec. 21-5-1). Wages include salaries, commissions, holiday pay, vacation pay, overtime, severance or dismissal pay, and bonuses and similar advantages agreed upon between the employer and employee, or provided by an established policy.

Employees must be paid at least twice every month and with no more than 19 days between paychecks.
Railroads. Railroad employers must pay their employees on or before the first day of each month for work completed during the first half of the preceding month. Payment for the second half of the month must be made on or before the 15th day of the following month (WV Code Sec. 21-5-2).
Wages may be paid in cash or by check or money order drawn on banks convenient to the place of work where arrangements have been made for cashing. An employer and employee may agree in writing to pay wages by direct deposit into the employee's account. The agreement must identify the employee, the financial institution, the type of account, and the account number. Employers may also pay employees by deposit or electronic transfer of immediately available funds into an employee's payroll card account in a financial institution.
The only allowed deductions from pay are those permitted by law or authorized in writing by the employee (WV Code Sec. 21-5-1).
When an employee quits or is laid off or fired, he or she must be paid on or before the next regular payday. The law provides a uniform time period for all discharged employees. If an employee requests his or her final paycheck be sent by mail, the ...
