West Virginia does have a state prevailing wage law for public improvement contracts of more than $500,000(WV Code Sec. 21-5A-1et seq.WV Code Sec. 21-5A-6). The law requires contract provisions regarding the following:
Wages. Under West Virginia law, contracts for public improvements, including construction, reconstruction, improvement, enlargement, painting, decorating, or repair must include in their specifications minimum wages for various classifications of employees.
Contract rates may not be lower than prevailing rates established annually by Workforce West Virginia. Rates for each classification of employee must be posted conspicuously at each job site. The rates will not remain in effect for a period longer than 15 months from the date they are published. However, any changes in rates will not affect construction of a public improvement already under way.
