Arizona Wage and Hour Investigations: What you need to know

Child labor wage investigations. In order to determine compliance with child labor laws, the state industrial commission (or any authorized representative) may enter a place of business where minors are employed and examine all the employer's books, registers, payrolls, and other records which in any way relate to the wages of minors. The investigator may also require the employer to provide a “full and correct” written statement of wages paid to all minors employed (AZ Rev. Stat. Sec. 23-312). Equal pay. Any employer who violates Arizona's equal pay provisions is liable to the affected employee for the amount of the wages of which the employee was deprived (AZ Rev. Stat. Sec. 23-341). There is additional information.
Wage claims. If an employer fails to pay wages due any employee, the employee may recover triple the amount of the unpaid wages (AZ Rev. Stat. Sec. 23-355). Alternatively, an employee may file a written claim with the labor department for unpaid wages of up to $5,000 if the claim is filed within 1 year (AZ Rev. Stat. Sec. 23-356).
If the state Department of Labor determines that the claim for unpaid wages is valid, the department will direct the employer to pay the unpaid wages (AZ Rev. Stat. Sec. 23-357). If the employer does not pay the wages due within 10 days, the employer must pay the employee triple the amount of the unpaid wages, plus interest (AZ Rev. Stat. Sec. 23-360).
