Utah Equal Pay Acts: What you need to know

Utah does not have a separate equal pay law requiring that men and women be paid equally for equal work. However, under the Utah Antidiscrimination Act, employers are prohibited from compensation discrimination based on race, color, gender, pregnancy and childbirth, age (40 years and over), religion, national origin, disability, sexual orientation, or gender identity (UT Code Sec. 34A-5-106). Under the Act, it is unlawful for an employer to pay different wages or salaries to employees having substantially equal experience, responsibilities, and skills for the particular job. The law provides an exception for increases in pay based on seniority if the increases are uniformly applied and available to all employees on a substantially proportional basis.

The Act applies to all public employers and private employers with 15 or more employees.
Most employers that are engaged in interstate commerce are subject to the requirements of the federal Equal Pay Act, which prohibits paying men and women differently for substantially equal jobs.
Under the Lilly Ledbetter Fair Pay Act of 2009, the federal fair employment laws were amended so that each paycheck affected by an employer's prior discriminatory practice or decision constitutes an unlawful discriminatory act that triggers a new deadline for filing a pay discrimination claim. An employee alleging discrimination must be able to show that the paycheck or other compensation was affected by a past discriminatory act.
