West Virginia Notices (Posting): What you need to know

West Virginia requires that employers post a number of notices informing workers of their rights and obligations under various employment laws. The notices must be placed conspicuously enough to be seen easily by employees as they enter or exit the workplace.

Discrimination. A notice must be posted setting forth provisions of the Human Rights Act (WV Code Sec. 5-11-17).
E-Verify. State law requires certain employers to register and participate in the federal E-Verify work authorization program. Upon completion of E-Verify registration, covered employers must post a notice of E-Verify participation as well as a Right to Work poster distributed by the federal Office of Special Counsel. Both notices must be displayed in at least English and Spanish.

Family/medical leave. Employers must post a notice setting forth an employee's rights under the Parental Leave Act (WV Code Sec. 21-5D-9).
Food or meals. Notice must be posted that employees are not allowed to take food into any room in a factory, mercantile establishment, mill, or workshop where a poisonous substance or noxious fume is present (WV Code Sec. 21-3-10).
Health and safety. Employers of 10 or more employees that are using or producing hazardous chemicals must post a warning notice informing employees of each substance used in the workplace and indicating symptoms of overexposure to each. The notice must prominently state: WARNING NOTICE (WV Code Sec. 21-3-18(c)).
Unemployment. Employers that pay wages of over $1,500 or more in any calendar quarter or have employed at least one person during 20 calendar weeks must post a notice informing employees of the unemployment law's benefit rights and claim procedures. When an employee becomes unemployed, the employer must provide him or her with a copy of the unemployment claims regulations (
