Connecticut Workers' Compensation: What you need to know

Workers' Compensation insurance provides disability benefits and medical coverage for workers who are injured or who become ill as a result of their employment. All employers of one or more employees in Connecticut must either provide workers' compensation insurance or furnish proof of financial ability to act as their own insurer.

Almost all employees in Connecticut are covered by workers' compensation, including full-time and part-time employees, citizens and noncitizens, and minors. Individuals working in or around a private home for not more than 26 hours each week, are an exception to the rule and are not covered by workers' compensation.
Employers cannot exempt themselves from workers' compensation coverage, except that officers of a corporation or partners operating partnerships may request in writing to be excluded from coverage. Also, an exception may occur when an individual claim is settled with the approval of the commissioner of the Workers' Compensation Commission.
“No-fault” system. Workers' compensation is a “no-fault” system. Under this system, it makes no difference who is to blame for the injury: The employee receives compensation as long as the injury arose “out of and in the course of employment.” This no-fault aspect distinguishes workers' compensation from ordinary “tort” law, which provides for the compensation of injured people in most other circumstances. Under tort law, a person receives compensation only if the injury was caused by someone else's carelessness. The operative legal term is “negligence,” which is simply the failure to use due care.
