Hawaii Workers' Compensation: What you need to know

Virtually all employees in Hawaii are covered by the Hawaii Workers' Compensation Act, including public employees and members of the Hawaii National Guard and state defense force. Volunteer firefighters, reserve police officers, public board members, volunteer boating enforcement officers, and volunteer conservation and resource enforcement officers are covered and are considered employees of the entities in which they serve in a non-paid capacity. For determination of benefits, these persons' wages are the wages they earn in any paid employment. Volunteers who are not specifically covered but who work under the direction of a state or county employer are entitled to medical benefits only. Only the following employment classifications are excluded from coverage:

• Volunteer or unpaid employees of a religious, charitable, educational, or nonprofit organization, or individuals working in exchange for aid
• Student employees whose service is rendered in return for room, board, or tuition
• Licensed and ordained clergy
• Domestic employees who earn less than $225 per quarter
• Real estate salespeople or brokers who receive their full compensation solely by way of commission
• Corporate officers who perform services without compensation for the corporation, which has no employees and in which the officer is at least a 25 percent stockholder
• Individuals with an ownership interest of 50 percent or more in the corporation they work for
• A partner of a partnership, a partner of a limited liability partnership (LLP) who has 50% or more interest in the LLP, a member of a limited liability company (LLC) who has 50% or more interest in the LLC, and sole proprietors.
