Georgia Advertising: What you need to know

The Georgia Age Discrimination Act prohibits hiring practices that discriminate against individuals who are between the ages of 40 and 70 (GA Code Sec. 34-1-2). The Act covers all public and private employers, regardless of size.

The Georgia Equal Employment for Persons with Disabilities Code prohibits employers from printing or publishing (or causing to be printed or published) any notice or advertisement relating to employment that indicates any preference, limitation, specification, or discrimination based on disability, unless the criteria are job related (GA Code Sec. 34-6A-4).
Georgia does not have a comprehensive antidiscrimination-in-employment law that covers private employers; however, employees are subject to federal discrimination laws.
Georgia's Fair Employment Practices Act prohibits public employers from printing or publishing any notice or advertisement that expresses any preference with respect to race, color, religion, national origin, sex, disability, or age, unless the criteria are bona fide occupational qualifications for employment (GA Code Sec. 45-19-31). The Georgia Commission on Equal Opportunity enforces the Act.
