Comparison: State vs. Federal

Rules. Many mobile source regulatory programs implemented at the federal level are having a positive effect on air quality in Arkansas. ADEQ has established regulations prohibiting tampering with emissions control devices on vehicles and regulations addressing visible emissions from vehicles and locomotives.

Administration and enforcement. DEQ administers and enforces the antitampering and visible emissions requirements. EPA administers and enforces other mobile source programs at the federal level.

Antitampering Requirements

AR Reg. 18.701(A)

The owner or operator of a motor vehicle that incorporates a system for the control or emissions from the crankcase or exhaust system, or for the control or evaporative emissions, must maintain the system in good operable condition and must use it at all times that the vehicle is operated. The operator of such vehicle must not intentionally make the system inoperable or remove it, except to install a proper replacement.
