Comparison: State vs. Federal

Rules. California has established a policy encouraging the voluntary disclosure of regulatory violations by offering incentives for self-reporting that include the potential for waiving or reducing a portion of the penalty.

California has also established requirements for the registration of environmental assessors to assist small- and medium-size businesses with site evaluations to determine if there is any contamination caused by the release of hazardous substances or wastes and what actions are necessary to remediate the contamination.

Administration and enforcement. Cal/EPA's Office of the Secretary oversees California's voluntary disclosure audit policy. DTSC's OEHHA is responsible for the environmental assessor registration process.
