Comparison: State vs. Federal

Rules. Alabama generally follows the federal financial responsibility requirements with additional state requirements for hazardous waste and scrap tire transporters, solid waste landfills, aboveground storage tanks (ASTs), and used oil transporters. Alabama has adopted by reference the federal financial responsibility rules for underground storage tanks (USTs). See the national section FINANCIAL RESPONSIBILITY for federal rule guidance.

The Alabama Underground and Aboveground Storage Tank Trust Fund may serve as the required financial responsibility mechanism for storage tanks. See the state section UNDERGROUND STORAGE TANKS for more information.

Administration and Enforcement. ADEM's Land Division administers and enforces the requirements for hazardous waste transporters, scrap tire transporters, and solid waste landfills. ADEM's Water Division administers UST and AST requirements, including financial responsibilities.
