Comparison: State vs. Federal
• Rules. Arkansas generally follows federal financial responsibility requirements, with additional rules for pesticide applicators, certain solid waste facilities, and solid waste transporters.
Arkansas follows the federal financial responsibility requirements for hazardous waste treatment, storage, and disposal facilities (TSDFs), and underground storage tanks (USTs). See the national section FINANCIAL RESPONSIBILITY for the federal rules.
Refer to Table in this section for a summary of state financial responsibility requirements.
The state also requires financial assurance to be eligible for reimbursement from the Arkansas Petroleum Storage Tank Trust Fund for cleanup costs in the event of accidental releases or contamination. For more information, see the state section UNDERGROUND STORAGE TANKS.
• Administration and enforcement. ADEQ is responsible for the administration and enforcement of the state's TSDF, UST, and liquid animal waste management system financial responsibility requirements.
