Comparison: State vs. Federal
• Rules. Oklahoma adopts by reference the federal hazardous materials regulations as they apply to motor carriers with some exceptions that apply to intrastate farming operations. Oklahoma also has additional reporting requirements in the event of certain hazardous materials incidents.
Any company engaged in containment, removal, and/or remediation of hazardous materials spills on highways in Oklahoma must be licensed by DEQ. See the state section EMERGENCY PLANNING AND RESPONSE for more information.
• Administration and enforcement. DPS administers and enforces the motor carrier safety and hazardous materials transportation regulations. OCC is in charge of registering and permitting.
DEQ administers and enforces the regulations for cleanup services and operators.
