• Rules. New Hampshire's UST program has received federal approval; therefore, all UST issues in the state are handled by the DES. However, certain federal rules apply when there is a potential for a discharge of oil into navigable waters (40 CFR 112.1). The state imposes tank fees and requires that tank tightness testers submit training certification to the DES. Some local authorities have additional tank requirements.
