Rules. West Virginia has received U.S. Environmental Protection Agency (EPA) authorization to administer its underground storage tank (UST) program. The state generally adopts federal regulations with additional notification, fee, certification, and training requirements. See the national section UNDERGROUND STORAGE TANKS for a summary of the federal requirements.

The West Virginia Department of Environmental Protection (DEP) has implemented the provisions of the federal UST Compliance Act (USTCA) of the Federal Energy Policy Act of 2005 requiring states to establish requirements for new or replacement USTs, piping and dispensers to be secondarily contained, tank inspection, delivery prohibition to noncompliance tanks, and UST operator training requirements.
