Comparison: State vs. Federal

Rules. Delaware's community right-to-know reporting and RMP requirements for material safety data sheets (MSDSs) follow federal rules. Facilities must submit MSDSs to DNREC, but they do not need to submit them directly to SERC, LEPCs, or local agencies unless a specific request is made.

Because Delaware is not a "state plan" state (it does not have a federally approved state job safety and health regulatory program), federal OSHA governs MSDS requirements in the private sector workplace. The state has adopted its own toxic substance worker "right-to-know" law that governs public sector workplaces, but there is no implementation or enforcement of the rule.
