Comparison: State vs. Federal

• Rules. The federal OSH Act governs occupational safety and health, including MSDS requirements, in the private sector workplace. There are no workplace safety and health rules for public sector (state government operations) employers. For information on the federal requirements, see the national section MATERIAL SAFETY DATA SHEET.

The state's community right-to-know requirements have MSDS provisions, but they mirror the federal requirements. See the state section COMMUNITY RIGHT-TO-KNOW for information.

• Administration and enforcement. OSHA Region 4 administers and enforces occupational safety and health, including MSDS requirements, in the private sector workplace. MEMA administers and enforces state community right-to-know requirements.
