Comparison: State vs. Federal

Rules. The state follows federal EPCRA requirements for the submission of material safety data sheets (MSDSs) to local emergency response agencies upon request. It also follows federal MSDS retention requirements for facilities that process or handle highly hazardous substances (RMP).

Because South Carolina has its own federally approved job safety and health regulatory program, state law governs MSDS requirements in both the private and public sector workplaces. The SC OSH has adopted all the standards of the federal Occupational Safety and Health Act (OSH Act), including the Hazard Communication Standard and MSDS requirements.
