Comparison: State vs. Federal
• Rules. Although the state follows the federal hazardous waste disposal rules, Maryland's hazardous waste disposal capacity is severely limited because there are no hazardous waste landfills in the state. In addition, and in contrast to the federal rules, Maryland prohibits the disposal of hazardous waste in underground injection wells.
Maryland's other types of hazardous waste disposal facilities, such as surface impoundments and incinerators, are more strictly regulated than under the federal rules because of the state's more stringent facility design, operating, and permit fee rules.
• Administration and enforcement. MDE's Land Management Administration administers and enforces the hazardous waste disposal requirements in Maryland.
