Comparison: State vs. Federal

Rules. Delaware has adopted the federal rules that cover the exporting and importing of hazardous wastes, as well as the regulations that cover transfrontier shipments of hazardous waste for recovery, with additional reporting requirements. Delaware has also adopted the federal rules regarding exporting and importing universal wastes. See the national section UNIVERSAL WASTES for more information.

Administration and enforcement. DNREC administers and enforces the hazardous waste importing and exporting rules in Delaware.

Although Delaware has EPA authorization to administer the federal hazardous waste program, states cannot receive certain import/export provisions that will continue to be administered by EPA. See the national section EXPORTS AND IMPORTS OF HAZARDOUS WASTE for more information.
