Comparison: State vs. Federal

Rules. Florida adopts by reference the federal requirements for exporting and importing hazardous waste (40 CFR 262.50 to 262.60) with additional notification and annual report requirements.

Administration and enforcement. DEP administers and enforces the state's rules for exporting and importing hazardous waste. However, there may be some instances where EPA enforces these rules. Check with EPA's Region 4 office before exporting or importing hazardous waste.

Florida requires that the primary exporter file a copy of the advance notification, the annual report, and any exception report with DEP.

Primary exporters of wastes must send a copy of their annual report to DEP by March 1 each year.

Florida includes in its regulations the extra requirement to send a copy of the signed import tracking document to DEP. See the national section EXPORTS AND IMPORTS OF HAZARDOUS WASTE for more information on the preparation of these reports.
