Comparison: State vs. Federal
• Rules. Pennsylvania has adopted by reference the federal Resource Conservation and Recovery Act's (RCRA) hazardous waste import and export rules. DEP, as well as EPA, must be notified of export activities. DEP modified its regulations to match the federal time frame of 60 days' notice before shipment. Pennsylvania has adopted the federal hazardous waste transporter regulations, with additional requirements for insurance, safety, and responses to discharges and spills. See the state section HAZARDOUS WASTE TRANSPORTERS for additional information.
EPA requires Pennsylvania (and all states) to use the revised federal form of manifest: the new standardized Uniform Hazardous Waste Manifest (EPA Form 8700-22) and its continuation sheet (EPA Form 8700-22A). The state's rules for hazardous waste manifest preparation and use must now be the same as the federal rules, and waste handlers should go to the national section MANIFESTS for guidance.
