Comparison: State vs. Federal

· Rules. Arkansas requires owners and operators of land treatment facilities in Arkansas to comply with the federal land treatment facility rules. In addition, owners and operators of hazardous waste treatment, storage, and disposal facilities (TSDFs) that engage in land treatment activities must comply with additional permit application and fee requirements and adhere to state facility performance standards.

· Administration and enforcement. ADEQ's Hazardous Waste Division administers and enforces the land treatment facility requirements in Arkansas.

State Requirements

FACILITY PERMIT STANDARDS

Hazardous waste facility owners and operators in Arkansas are subject to several additional state permit application conditions not included in the federal rules. The state has additional permit application requirements for TSDFs, including those regarding the need for a baseline health survey before operation, mandatory public hearings before permit approval, and additional TSDF ownership disclosure requirements.
