• Rules. Montana has adopted the EPA federal listed waste regulations. See the national section LISTED WASTES to review the federal listing criteria.
If a waste cannot be identified in one of the state hazardous waste lists, it still might be hazardous because it exhibits one or more characteristics of hazardous waste—ignitability, corrosivity, reactivity, or toxicity. See the national sections CHARACTERISTIC WASTE and HAZWASTE DETERMINATION (CLASSIFICATION) for additional information on hazardous waste identification and classification.
EPA provides an exclusion (delisting) procedure, allowing persons to demonstrate that a listed waste from a particular generating facility should not be regulated as a hazardous waste. Montana does not have EPA authorization to delist Resource Conservation and Recovery Act (RCRA) hazardous wastes. See the state section DELISTING PETITIONS for more information.
