Comparison: State vs. Federal

Rules. At present, Delaware has no landfills that accept hazardous waste, including polychlorinated biphenyls (PCBs). However, the state's hazardous waste program retains hazardous waste landfill regulations that follow the federal regulations.

EPA regulates chemical substances under the Toxic Substances Control Act (TSCA). TSCA governs the import and export of toxic chemicals from the United States, such as PCBs. TSCA is a federal program that is not delegated to the states. See the national section TOXIC SUBSTANCES CONTROL ACT for more information.

Administration and enforcement. EPA's Region 3 office enforces federal regulations for PCB disposal and storage. DNREC is responsible for administering the rules that prohibit the disposal of PCBs in landfills and hazardous debris treatment rules.
