Comparison: State vs. Federal

• Rules. The DEC regulates polychlorinated biphenyls (PCBs) and PCB items as hazardous waste. These regulations are in addition to the federal regulations for storage, labeling, disposal, and transformer decommissioning.

New York has adopted the federal listed hazardous waste regulations and includes additional state-listed hazardous wastes. Listed hazardous wastes include certain concentrations of PCBs. See the state section LISTED WASTES for more information.

Administration and enforcement. The EPA enforces the federal rules for PCB disposal and storage in New York. The DEC administers and enforces the state's requirements for managing PCBs and PCB items as hazardous waste.
