Comparison: State vs. Federal

Rules. The state has been delegated authority by the U.S. Environmental Protection Agency (EPA) to administer the National Pollution Discharge Elimination System (NPDES) permit program for pretreatment. See the national section PRETREATMENT STANDARDS, and contact the DEQ for more information.

Administration and enforcement. DEQ's Surface Water Division administers the state's water quality program and enforces pretreatment requirements in Mississippi.

Mississippi has adopted the federal pretreatment standards by reference except for the following:

In addition, Mississippi has amended the federal regulation under 40 CFR 403.1(b)(1) as follows: "pollutants from nondomestic sources covered by pretreatment standards that are indirectly discharged into or transported by truck or rail or otherwise introduced into public or privately owned treatment works." Mississippi also has an additional analyzing requirement for municipalities.

Operating permits. Any industrial facility discharging wastewater into a publicly owned treatment works (POTW) that is subject to the federal pretreatment standards, or that the DEQ ...
