Comparison: State vs. Federal

Rules. Alabama has adopted by reference federal regulations for variances from effluent limitations or categorical pretreatment standards. Effluent limitations must be implemented in order to protect state water quality standards. See the national section WASTEWATER VARIANCES for the federal requirements.

ADEM also issues variances for permits covering activities in coastal areas.

Administration and enforcement. ADEM's Water Division administers and enforces the water quality rules in Alabama under the authority of the Alabama Water Pollution Control Act. Variance requests under the state's NPDES permit program Coastal Area Management Program are processed by ADEM.
