Comparison: State vs. Federal

· Rules. Oregon has adopted federal regulations for variances from effluent limitations or categorical pretreatment standards for fundamentally different factors (FDF) under 40 CFR 125. See the national section WASTEWATER VARIANCES for federal requirements for a wastewater variance. In addition, DEQ has adopted specific rules for variances from state drinking water standards and hardship variances from rules or standards pertaining to on-site sewage disposal systems.

· Administration and enforcement. DEQ's Water Quality Division together with EQC administers and enforces the state's water quality program and makes variance determinations.

All owners of sewerage systems that receive industrial waste subject to federal or state pretreatment standards must develop and implement a pretreatment program for controlling those industrial contributors. See the state section PRETREATMENT STANDARDS
