Comparison: State vs. Federal

Rules. Delaware regulates tidal wetlands at the state level under the state Wetlands Act. Nontidal wetlands are not directly regulated at the state level. Lands under tidal and nontidal waterways are regulated under the Subaqueous Lands Act. Delaware also regulates activities in the coastal zone of the state. Administration and enforcement. DNREC's DWR administers and enforces the wetlands permit rules in Delaware, as well as the Subaqueous and coastal permits. DNREC's wetlands jurisdiction is concurrent with the Corps that issues ...
