Montana Life Insurance: What you need to know

Employers have no obligation under Montana law to offer life insurance to their employees. However, if group life insurance is among the benefits offered to workers, certain minimum requirements must be satisfied (MT Code Sec. 33-20-1101et seq.).

Group characteristics. The group to be insured must consist of at least two employees. The group must include all employees or all employees belonging to the class defined as eligible for coverage defined based on conditions pertaining to their employment.
The policy may provide that “employees” include the employees of any subsidiary corporations and the employees, individual proprietors, and partners of any affiliates under common control. “Employees” may also include retired employees. No director of a corporate employer may be eligible for insurance under the policy unless he or she is otherwise eligible as a bona fide employee of the corporation by performing services other than the usual duties of a director. An individual proprietor or partner may be eligible for insurance under the policy only if he or she devotes a substantial part of his or her working hours to the conduct of the business of the proprietor or partnership. The policy and certificate must contain a provision setting forth the conditions, if any, under which the insurer reserves the right to require a person eligible for insurance to furnish evidence of individual insurability as a condition to part or all of the person's coverage.
Beneficiary. The employee may name anyone except the employer as beneficiary.
