Employers have no obligation under New Hampshire law to offer life insurance to their employees. However, if group life insurance is among the benefits offered to workers, certain minimum requirements must be satisfied (NH Rev. Stat. Sec. 408:15et seq.).
Group characteristics. Those eligible for coverage must include all employees of the employer or all employees belonging to the class defined (based on conditions pertaining to employment) as eligible for coverage. Employees may include the employees of one or more subsidiary corporations; the employees, individual proprietors, and partners of one or more affiliated corporations; proprietors or partnerships that are under common control; and retired employees.
Beneficiary. The employee can name anyone except the employer as beneficiary.
Employer/employee contributions. Employers are not required to contribute toward the cost of group insurance. If the employer pays the entire cost, all employees in the eligible class must be covered by the policy.
Coverage of dependents. A group plan may provide coverage for an employee's spouse and minor children.
Conversion. Employees, as well as their spouses and minor children, are guaranteed the right to convert group coverage to an individual policy in the event that the group member's employment is terminated or the member ceases for any other reason to be part of the class eligible for coverage. An individual who has been insured for 5 years and loses coverage because the policy terminates or is amended to terminate coverage for a class of insureds also must be allowed to convert to an individual policy whose value is limited to the lesser of the coverage under the terminated policy or $10,000.
