Minnesota Sick Leave: What you need to know

There is no Minnesota law requiring private employers to grant their employees sick leave, paid or unpaid, although many employers do grant it as a popular employee benefit. It is important to remember that if sick leave is promised, an employer may have a legal obligation to grant it. Minnesota courts have held that under certain circumstances, policies published in employee handbooks, oral promises, or practices that are simply understood as policy may constitute binding and enforceable implied contracts. Thus, employers should regularly review policy statements made in the handbooks or elsewhere, to ensure that they accurately reflect current policies and comply with the mandates of federal and state law. If not, they should be changed and employees notified of the changes.

Under Minnesota's Parental Leave Act, eligible employees are entitled to up to 6 weeks of unpaid leave for the birth or adoption of a child (MN Stat. Sec. 181.940et seq.). A separate provision of the law allows employees to take time off to care for a sick or injured child if the employer voluntarily provides the employees with personal sick leave benefits. If this is the case, employees may use their own accrued sick time for their children's illnesses as long as the care is reasonably necessary. The law applies to employers with 21 or more employees.
