The Fair Labor Standards Act (FLSA) is a federal law. It applies in every state, but the states are free to make laws that are more generous to employees and to regulate the rare cases in which federal law does not apply.

Minimum wage and overtime. Washington has enacted laws governing minimum wages and overtime, the focus of the federal law.
Washington has adopted regulations defining the overtime exemption for bona fide executive, administrative, and professional employees. These tests require that exempt employees be paid on a salary basis, be paid a salary of at least a specified minimum, and perform certain duties depending on their pay level and the exemption that applies.
