Hawaii Paychecks: What you need to know

Wage payment laws affect all private employers in Hawaii. Wages include compensation for labor or services performed by an employee, whether the amount is determined on a time, task, piece, commission, or other basis including the reasonable cost of furnishing an employee with board, lodging, or other facilities if such board, lodging, or other facilities are customarily furnished by the employer (HI Rev. Stat. Sec. 388-1).

Payroll cards. Effective September 1, 2014, employers may use payroll cards to pay employees only if all of the following requirements are met:
• The employee must be given the option of receiving wages by direct deposit, check, or payroll card;
• The employer cannot mandate an employee's use of a payroll card;
• The employer cannot make participation in the payroll card program a condition of hire or continued employment;
• The employee must voluntarily authorize the payment of wages using a payroll card, in writing or with an electronic signature, without intimidation, coercion, or fear of discharge or reprisal;
• Before obtaining the employee's consent, the employer must provide the employee, in writing, in plain language, in at least 10-point font, a description of the employee's options for receiving wages, the payroll card fee schedule, a notice that states whether third parties may assess additional fees relating to the use of the payroll card, and a list of the services available to the employee with the payroll card;
• The employer is responsible for fees that have been assessed against the employee outside the payroll card fee schedule;
• The employer must agree to honor a written request by the employee to change the method of receiving wages from a payroll card to another method ...
