Texas Paychecks: What you need to know

Wages are compensation owed by an employer for labor or services rendered by an employee, determined by time, job, piecework, commission, or any other method. Vacation, holiday, paid sick leave, paid parental leave, and severance pay are all considered to be wages if the employer has a written policy or a written agreement with an employee that promises such payments (TX Labor Code Sec. 61.001).

Time of payment. Employers must pay most employees at least twice a month. The pay periods should be as equal in length as possible. Employers may pay exempt employees at least once a month. This category includes administrative, executive, and professional employees, including teachers in elementary or secondary schools and outside salespersons (TX Labor Code Sec. 61.011). Paydays must be designated in advance. If no payday is specified, paydays are on the 1st and 15th of each month.
Commissions. Wages paid on commission and bonuses are due either by agreement between the employee and employer or a collective bargaining agreement, in a timely manner as is required for the payment of noncommission wages.
Place of payment. Employers may give their employees their wages by (TX Labor Code Sec. 61.017):
• Delivering them to the employee at the employee's regular place of employment during regular employment hours
• Delivering them to the employee at a time and place agreed on by the employer and employee
• Sending them to the employee by registered mail, to be received by the employee not later than payday
• Delivering them by any of these methods to a person designated by the employee in writing
