Nebraska Facilities: What you need to know

It is the duty of the employer to keep workplaces clean and sanitary, properly ventilated, and dry (NE Rev. Stat. Sec. 48-404).

Any employer with one employee or more must provide access to an adequate number of properly enclosed toilets or privies.
The toilet facility must be properly ventilated and have no effluvia arising from any toilet or drain.
Facilities for male and female employees must be separate for each sex and adequately identified. No person may use a toilet designated for the other sex. When the number of employees is more than 20 of either sex, there must be an additional toilet stall for that sex. When the number of employees is above 40, the number of toilets shall be equal for each sex (NE Rev. Stat. Sec. 48-401).
In workplaces where the labor performed by workers requires changing of clothes, wholly or in part, separate dressing rooms must be provided for females (NE Rev. Stat. Sec. 48-402).
State law allows breastfeeding in public and private locations. The law requires that a mother may breast-feed her child in any public or private location where the mother is otherwise authorized to be. This includes places of employment (NE Rev. Stat. Sec. 48-1114(3)).
Although not specifically mentioned in the state law, in order to accommodate breast-feeding, employers may wish to set aside a quiet, private area other than a restroom stall and/or establish protocol or policies for employees who wish to breast-feed.
Smoking. The revised Nebraska Clean Indoor Air Act prohibits smoking in indoor public places, including workplaces (NE Rev. Stat. Sec. 71-5716et al).
