Virginia has adopted a program that has received federal approval. In all important respects, its requirements are identical to the federal standards, although state officials have enforcement powers and may enter any workplace or locations where work is performed to inspect conditions and equipment and privately question any employee, employer, owner, or agent VA Code Sec. 40.1-49.8.
Virginia law prescribes some very general standards for workplace facilities (VA Code Sec. 40.1-51.1). Under this law, which is administered by the Safety and Health Codes Board, employers must:
• Furnish employees with a workplace that is free of recognized hazards that are likely to cause death or serious injury.
• Give employees prompt information regarding their exposure to toxic material or harmful physical agents, and also inform exposed employees of the corrective action being taken.
• Post copies of any safety and health violation citations.
• Provide suitable means of protection against exposure to toxic substances.
